Road Accidents Involving Foreigners in Turkey: General Information

Tourists, temporary residents and drivers of foreign-registered vehicles can all be involved in road accidents in Turkey. The first steps after an accident directly affect the later compensation process.

At the scene

  • Safety first: call 112 if anyone is injured.
  • Report the accident to the police or gendarmerie and make sure an accident report is drawn up.
  • Photograph the position of the vehicles, the damage and the road conditions.
  • Note the other party's identity, driving licence, vehicle registration and insurance details; take contact details of any witnesses.
  • Do not sign a report in a language you do not understand; ask for an interpreter if needed.

Insurance

Notify your insurer promptly, under both the compulsory traffic insurance and any comprehensive (kasko) policy you hold. For foreign-registered vehicles the scope of cover may differ, so keep your policy documents.

Kinds of compensation

  • Medical costs and loss of earning capacity (temporary and permanent)
  • Vehicle damage, replacement vehicle costs and loss of value
  • Non-pecuniary damages
  • In case of death: compensation for loss of support and funeral costs

Where to apply and time limits

A claim can first be made to the insurer. If the dispute continues, the Insurance Arbitration Commission or the courts may be an option. The general limitation period is two years from when the injured person learns of the damage and the liable party, and ten years from the date of the accident in any case; if the act is also a crime, a longer criminal limitation period may apply (Code of Obligations Art. 72, Highway Traffic Law Art. 109).

If you have already left Turkey

People who return home can handle matters in Turkey through a representative. The requirements for a power of attorney depend on the country where it is issued.
